These Rules make provision with respect to the functioning, duties and powers of the Environmental Quality Commission established by Law and prescribe various measures the Commission shall take for the prevention of pollution of air or water. No person shall construct or modify any sources, install, modify, or use any equipment or device capable of causing or contributing to air or water pollution, or designed to prevent air or water pollution, without a permit from the Commission. All applications for a permit will be publicly posted and public hearings will be held if requested by an interested party. If the Commission does not grant a permit it shall issue a Preventive Order in respect of the proposed construction or modification which may contribute to air or water pollution. The Commission shall establish a territory-wide system under which a permit is required for the construction and operation of new sources of air pollution, and construction and operation, or modification to, existing sources. The Rules further require discharges into the waters of the territory to comply with all Rules of the commission and National Pollutant Discharge Elimination System Rules and Regulations and provide for emergency measures and enforcement.
